These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and SYNQ.EI LTD ("SYNQ", "we", "us", or "our") governing your access to and use of the SYNQ Experience Intelligence platform, including all software, services, APIs, and related materials (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.
SYNQ provides an AI-powered Experience Intelligence platform that analyses operational data to predict and prevent service friction, generates actionable insights through AI agents, integrates with IoT sensors and existing management systems, and delivers predictive analytics for hospitality, healthcare, and boutique studio environments.
To access the Services, you must provide accurate and complete registration information, be at least 18 years of age, and comply with all applicable laws. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You may use the Services only for lawful business purposes as described in your Service Agreement, for internal operations within your organisation, and for purposes consistent with the intended functionality of the platform.
You must not use the Services for any illegal or harmful purpose, attempt to gain unauthorised access to our systems, reverse engineer the Services, interfere with platform integrity, scrape or extract data without authorisation, resell or redistribute the Services, or use the Services to develop competing products.
All rights, title, and interest in and to the Services, including all software, algorithms, AI models, and documentation, are owned exclusively by SYNQ. You retain all rights to the data you provide ("Customer Data") and grant SYNQ a non-exclusive licence to process it solely to provide and improve the Services.
We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, update, or discontinue features with reasonable notice of material changes.
Fees are based on subscription tier and usage, payable in advance on a monthly or annual basis. All fees are non-refundable except as required by law. Late payment may result in service suspension.
Both parties agree to protect Confidential Information using reasonable security measures, use it only for purposes of the Services, and not disclose it to third parties without consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that AI-generated insights will be accurate or suitable for your purposes. You acknowledge that AI systems are probabilistic and human oversight is required for critical decisions.
SYNQ's total aggregate liability will not exceed the greater of £1,000 or the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages. These limitations do not apply to liability for death, personal injury, fraud, or any liability that cannot be excluded by law.
Either party may terminate with 30 days' written notice or immediately for material breach. Upon termination, Customer Data will be available for export for 30 days, after which it may be deleted.
These Terms are governed by the laws of England and Wales. Before initiating legal proceedings, the parties agree to attempt informal negotiation for 30 days, followed by mediation if necessary.
You acknowledge that AI systems are probabilistic and may produce errors, AI-generated insights are recommendations not guarantees, human judgement is required for important operational decisions, and you are responsible for validating AI recommendations before implementation. The Services do not provide medical, legal, financial, or professional advice.
